The Urban Forest Management Strategy includes a new tree bylaw that protects and regulates the removal of trees on private and City-owned land. For more information and complete outline of the bylaws visit

The QPRA has asked the city for an update on the tree removal at 321 & 323 Fifth St. and we received the following response:

City bylaw enforcement has advised that the developer of the site submitted a survey that showed the location of the centre of the tree and noted the size of the tree but it showed the tree totally on private property. On December 16th the City commissioned an independent survey to determine ownership of the tree. The survey showed that the edge of the tree was over the front property line onto City property by three inches. Since the tree was originally planted on private property and then grew a bit onto the City property, it was determined that the City had no viable claim to ownership of the tree that would stand up in any enforcement procedure. At this time the City does not contemplate taking any action on the cutting of the tree.
